The Housing Services Act, 2011

The Act

The Housing Services Act, 2011 came into force on January 1, 2012. This Act replaced the Social Housing Reform Act (SHRA) and includes a number of key changes for non-profit housing providers administered under the SHRA and Municipal Service Managers.

The Housing Services Act provides a new legislative framework for the delivery of housing programs in Ontario. More information on the Housing Services Act can be found here.

Changes to Rent Geared to Income & Local Rules Summary

Changes to rules about access to RGI and RGI administration fall loosely under four objectives:

  1. Greater local flexibility for service managers in order to meet local housing needs
  2. Greater flexibility to deal with extenuating circumstances, in an effort to keep tenants housed and have the punishment suit the crime
  3. Reduction in administration time, and
  4. Room for service managers to implement asset building programs for low income households

No significant changes were made to the definition of income or the method by which RGI is calculated.  Although consultation was held on these matters, the financial impact for Services Managers requires further study and has thus resulted in postponement of changes to these areas.   

The attached summary outlines areas that will be left to Service Manager discretion.  RGI administrators will rejoice in the omission in the new regulations of any reference to "opportunity to comment". 


The Housing Policy Statement

The Housing Policy Statement (HPS) establishes the housing policy directions of the Province and outlines items to be addressed in local Housing and Homelessness Plans.


Background

The Housing Services Act, 2011 preserves the administrative and funding responsibility for housing with Service Managers within a more flexible framework.

The main changes include:

  • Service Managers being required to develop 10-year local housing and homelessness plans that will be periodically reviewed.
  • The establishment of areas of provincial interest that must be included in a Service Manager's local plan.
  • Elimination of some forms of ministerial consents.
  • Changing the waiting list system to permit Service Managers to design their own local systems and permit waiting applicants to cross over from one Service Manager wait list to another.
  • Change the name of the Social Housing Services Corporation (SHSC) to the Housing Services Corporation and providing them broader flexibility to offer new optional services and supports.

Many of the rules, and much of the detail, of how things will work are defined by the Act's recently released Regulations.
